i understand that in butterfly if the feet cross and it is a constant feet cross with each stroke its a dq, what if its every now and again (like in the last 50m - the swimmer does two/three times) is this a dq?

Is there a difference between "must break the surface of the water throughout the race" and "must remain at the surface of the water throughout the race"?
