If a swimmer chooses to swim breaststroke in a freestyle event does the swimmer have to comply with the breaststroke rules?

No, the swimmer only has to comply with the freestyle rules. The swimmer may touch in any manner (SNSW Rules SW5.2).

Thanks, would this be the same with backstroke in a freestyle handicap event? How would the dive work?

Again, freestyle rules apply, so swimmers in a freestyle race start with a dive (SNSW SW 4.1).
